Agreement between Tatiana Dudova (Coach) and the Client whereby Coach agrees to provide coaching services to Client on agreed upon topics.
Coaching is an alliance between Coach and Client in a thought-provoking action-driven process that inspires the Client to achieve success in the area of their choice.
Coaching Relationship: The Coach serves as your partner in self-discovery, personal growth, goal setting and goal attainment. Coach does not diagnose or treat disorders.
Coach agrees to maintain the ethics and standards of behaviour set by the International Coach Federation (ICF), www.coachfederation.org/ethics.
Client is responsible for creating and implementing his/her own decisions, choices, actions and results. As such, Client agrees that Coach is not and will not be liable for any actions or inaction, or for any direct or indirect result of any services provided by Coach.
Client understands that coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
Client understands that coaching is not to be used as a substitute for professional advice by legal, mental, medical, or other qualified professionals and will seek independent professional guidance for such matters.
If Client is currently under the care of a mental health provider, Coach recommends that Client inform the mental health provider about entering into a Coaching Program.
The Twice As Successful™ program offers a dual-career success curriculum for couples and addresses Client’s specific challenges related to building a successful career as part of a professional couple. Client may participate in the program alone or with partner.
In order for coaching to be most effective, Client must make a commitment to take an active part in the process, which may include identifying goals and desired outcomes, doing agreed-upon homework assignments and follow-up activities between sessions.
Client supplies the agenda or topic of discussion for each session.
Coach may suggest agenda, depending on progress made, previously given assignments etc.
Coach will assist Client in realising their full potential, and respect Client’s right to make informed and responsible decisions. Client needs to be aware that results cannot be guaranteed, and that Client is entering into coaching with the understanding that the effort and energy that Client puts into coaching will largely determine the outcomes Client experiences.
Meetings will take place over telephone or Skype, unless otherwise agreed upon.
Coaching is delivered during bi-weekly scheduled 40-minute coaching sessions as scheduled by the Client.
Client is responsible for scheduling each call time in advance.
Coach will call Client at the pre-determined time at a telephone or Skype number provided by Client.
If Client is late for a call, Coach may need to end the session at the originally scheduled time, although Coach will extend the call if schedule permits.
After 15 minutes of unsuccessfully attempting to reach Client, Coach retains the right to end the attempt.
Coach is under no obligation to reschedule a missed coaching session unless advance cancellation is given. Cancellation notice should be given by email or text at least 24 hours prior to the call.
Coach will aim to respond to all relevant emails within 2-3 days.
There is no limit to the number of emails that can be sent but Client is advised to use common sense and avoid excessive or repetitive emailing.
Termination of Services
Either Client or Coach may terminate this agreement at any time with one week’s written notice.
Coach will refund Client for unused portion of prepaid coaching services.
This coaching relationship, as well as all information (documented or verbal) that Client shares with Coach as part of this agreement, is bound to confidentiality by the ICF Code of Ethics but is not considered a legally confidential relationship (like medicine or law).
Coach agrees not to disclose any information pertaining to Client without Client’s written consent.
Coach will not disclose Client’s name as a reference without Client’s consent.
Confidential information does not include information that:
- was in the Coach’s possession prior to its being furnished by the Client;
- is generally known to the public or in Client’s industry;
- is obtained by Coach from a third party, without breach of any obligation to the Client; and
- is independently developed by Coach without use or reference to Client’s confidential information; or
- that Coach is required by law to disclose.
According to the ethics of the coaching profession, topics may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, further coach professional development and/or consultation purposes.
Except as expressly provided in this agreement, Coach makes no guarantees or warranties, express or implied. In no event will Coach be liable to Client for consequential or special damages. Notwithstanding any damages that Client may incur, Coach’s entire liability under this agreement, and Client’s exclusive remedy, will be limited to the amount paid by Client to Coach under this agreement for all services rendered up until the termination date.
Client agrees to utilise these coaching services will the full understanding that Coach in no way liable for the Client’s decisions, actions and outcomes. Client also agrees to hold Coach free of all liability and responsibility for any adverse situations created by Client as a direct or indirect result of a specific referral, advice given or any actions taken while working with Coach.
Acceptable Use Policy
Client agrees to abide by all applicable laws, regulations and codes of conduct and ensure that any content uploaded or stored by Client does not infringe the rights of others.
As part of the coaching process, Coach will provide training materials and handouts to Client. No part of such materials may be resold or distributed for sale or used for training other persons. Nor can any part of such materials be combined with, or become incorporated in, any other content or programs, or be used to create any content which is substantially similar to programs delivered by Coach to Client.
All material sent to Client by e-mail or any other form (“the content”) belongs to Coach. Client may retrieve and display content provided by Coach on a computer screen, print individual pages on paper, photocopy and store such pages in electronic form for Client’s personal, non-commercial use.
Coach owns the copyright and all other intellectual property rights associated with the content, save where otherwise stated.
Except as specifically stated in these terms, Client may not do any of the following without prior written permission from Coach:
Reproduce, modify or in any way commercially exploit any of the content;
Redistribute any of the content (including by using it as part of any library, archive or similar service);
Remove the copyright or trademark notice(s) from any copies of content made in accordance with these terms.
